Derelict Sites

An important element in the development of the city is the removal/development of derelict lands which detract or are likely to detract from the amenity, character or appearance of land within the city. Under the Derelict Sites Act, 1990 the local authority has an obligation to eliminate and/or prevent dereliction. 

In brief - a Derelict Site is:

  • Any land which may have buildings on it which are in a derelict or dangerous condition;
  • Any land which is in an unsightly, neglected or objectionable condition;
  • Any land with a deposit or collection of litter, rubbish, debris or waste on it, where there is no permit or right to have such a deposit or collection.

Under the provisions of the Derelict Sites Act the Council may:

  • Levy a Derelicts Sites Levy in respect of certain sites entered in the Derelict Sites Register;
  • Instruct property owners to carry out certain predetermined works;
  • Remove the dereliction and recover the costs incurred from the owner/occupier;
  • Compulsorily acquire derelict sites.

The Act also requires Local Authorities to maintain a Register of all derelict properties in their area. The Property Section maintains the Register on behalf of the City Council and the Register contains details of derelict properties, location, ownership details, and valuation. The Register is available for inspection at the reception desk at City Hall during normal working hours.
